Department of Transportation Releases Proposed Regulations for Traffic Mitigation Ordinance 

The Baltimore City Department of Transportation today released proposed regulations in compliance with Ordinance 11-529, Traffic Mitigation – Establishing Traffic Mitigation Zones, and specifically Section 3803.2 of the Building, Fire and Related Codes Article of the Baltimore City Revised Code. The Ordinance, adopted on November 21, 2011 by the Baltimore City Council and signed into law by Mayor Stephanie Rawlings-Blake on November 22, 2011 updates the City’s practices with regard to measuring and mitigating the traffic impacts of development projects.

Under the Ordinance, projects in any of five specific zones would pay a fee per trip generated, subject to certain credits and offsets. The fee would be established by the Board of Estimates based on a traffic mitigation plan for each zone, which is reviewed and approved by the Planning Commission.

A copy of the proposed regulations can be found on the Department of Transportation’s website at www.baltimorecity.gov. Copies may also be found at the front desk of the Department of Transportation, Department of Planning, Legislative Reference, Housing & Community Development (Permits Office), the Office of the Zoning Administrator and the Board of Municipal and Zoning Appeals.

A public hearing on the proposed regulations will be held on Wednesday, January 18, 2012 at 6:00 p.m. at 417 E. Fayette Street, 7th Floor. The regulations become effective on February 6, 2012, subject to changes made by the Department of Transportation based on public input and further technical review.
